Mexico City, Mexico, July 22, 2019 – In relation to: (i) the Engineering, Procurement and Construction Contract of the Atizapán – Atlacomulco High Specifications Toll-Road, in the State of Mexico (the “ATAT Toll-Road”), dated October 10, 2016, (the “EPC Contract”), entered into by and between Concesionaria AT-AT, S.A. de C.V. (“ATAT”), a subsidiary of Aleatica, S.A.B. de C.V. (“Aleatica” or the “Company”) (BMV: “ALEATIC”), and Constructora de Proyectos Viales de México, S.A. de C.V. (the “OHL’s Subsidiary”), a subsidiary of Obrascón Huarte Lain, S.A. (“OHL”); and (ii) the Relevant Events issued by the Company on April 8 and 9 and June 14, 2019 regarding the termination of the EPC Contract, the arbitration proceedings and the settlement agreement in connection thereto; Aleatica informs the market that, on this date, the foregoing arbitration proceedings were definitively finalized pursuant to the terms and conditions provided in the foregoing agreement, pursuant to which ATAT exercised its right to receive a payment from OHL’s Subsidiary.
Aleatica confirms that, as of this date, all business dealings with OHL in Mexico have been terminated.
These actions announced today are a positive development for the continuation of the project.
Aleatica reiterates its commitment to the project and to continue to expeditiously remobilize the construction works of the ATAT Toll-Road in compliance with the corresponding concession title.
