Pursuant to article 50, paragraph V, subparagraph b) of the general rules applicable to securities issuers and to other participants of the capital market (the “Rules”), OHL México, S.A.B. de C.V. (the “Company”) (BMV: OHLMEX), informs to the public that on November 20, 2015, its subsidiary, Concesionaria Mexiquense, S.A. de C.V. (“Conmex”) was summoned as an interested third party, to the administrative proceedings identified by the case 839/2015, that will take place before the Seventh Regional Unit of the Local Administrative Court of the State of Mexico, that was brought by Tecnología Aplicada Infraiber, S.A. de C.V. (“Infraiber”), against the Mexican Ministry of Communications and Highway, Airport, Connection and Auxiliary Systems of the State of Mexico (Sistema de Autopistas, Aeropuertos, Servicios Conexos y Auxiliares del Estado de México) (“Saascaem”). According to this lawsuit, Infraiber seeks to declare invalid the Sixth Amending Agreement dated January 20, 2015 (“Sixth Modification”) among other demands, for lack evidence of the faculties of the person who signed the Sixth Modification by Saascaem.
The Company, based on the opinions of internal and external advisors, considered the charges by Infraiber to be unfounded as they lack sufficient legitimate interest to challenge the Sixth Amendment of which it is not a part.
