Pursuant to Article 50, Section V sub-section b) of the General Provisions Applicable to Security Issuers and Other Participants of the Securities Market (Disposiciones de Carácter General Aplicables a las Emisoras de Valores y a Otros Participantes del Mercado de Valores), OHL México, S.A.B. de C.V. (“the Issuer”) informs that its subsidiary, Concesionaria Mexiquense, S.A. de C.V. (“Conmex”), was notified, as third injured party and not as defendant, of an injunction proceeding presented by Guillermo Magaña Sotelo, against the Ministry of Transport of the State of Mexico (Secretaría de Comunicaciones del Estado de México or “the Ministry”) and the System of Highways, Airports, Associated and Auxiliary Services of the State of Mexico (Sistema de Autopistas, Aeropuertos, Servicios Conexos y Auxiliares del Estado de México or “SAASCAEM”) which is under review before the Eleventh Court of the State of Mexico, located in Naucalpan de Juarez. By means of this proceeding, Guillermo Magaña Sotelo seeks to obtain a favorable resolution with respect to its arguments regarding certain acts through which the Ministry granted on February 25, 2003, more than 10 years ago, the concession for the construction, exploitation, operation, conservation and maintenance of the Eastern Highway System of the State of Mexico (Sistema Carretero de Oriente del Estado de México or “the Circuito Exterior Mexiquense”) as well as other acts related to the concession title.
Based on the opinion of its in-house and external legal counsel, the Company considers that Guillermo Magaña Sotelo’s allegations are without merit since there are no elements that justify his arguments.
